Please read these Terms of Service ("Terms") carefully before using the CloudySMS website and services operated by CloudySMS ("us", "we", or "our").
1. Acceptance of Terms
By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.
2. Description of Service
CloudySMS provides a software-as-a-service platform that allows businesses to manage WhatsApp marketing campaigns, automate responses, and handle customer support conversations via the WhatsApp Business API.
Note: We are a third-party provider and are not directly affiliated with Meta Platforms, Inc. Your use of WhatsApp is also subject to Meta's Terms of Service and Commerce Policy.
3. Acceptable Use
You agree not to use the Service to:
- Send unsolicited bulk messages (spam) in violation of WhatsApp's policies.
- Harass, abuse, or harm another person or group.
- Impersonate any person or entity or falsely state your affiliation.
- Send content that is illegal, offensive, or violates intellectual property rights.
Violation of these rules may result in the immediate termination of your account and reporting to Meta.
4. Subscriptions & Payments
Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis (such as monthly or annually).
- Free Trial: We may offer a Subscription with a free trial for a limited period of time. You may be required to enter your billing information in order to sign up for the free trial.
- Cancellation: You may cancel your Subscription renewal at any time through your account settings page.
- Refunds: Certain refund requests for Subscriptions may be considered by CloudySMS on a case-by-case basis and granted at the sole discretion of CloudySMS.
5. Limitation of Liability
In no event shall CloudySMS, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
6. Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect.
